Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Goler mobile application, the website goler.co, the venue administration panel, and all related services (collectively, the "Service") operated by Goler, Inc.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this age requirement. If you are under 18, you must have the consent of a parent or legal guardian.

2. Accounts

2.1 Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

2.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately at support@goler.co if you suspect unauthorized access.

2.3 Account Termination by You

You may delete your account at any time through the app or by contacting us. Your personal data will be handled as described in our Privacy Policy.

2.4 Account Termination by Us

We reserve the right to suspend or terminate your account if you violate these Terms, submit fraudulent reviews, or engage in conduct that harms the Service or its users.

3. The Service

3.1 What Goler Does

Goler is a venue intelligence platform. We collect visitor reviews from publicly available sources and through our platform, process them through an automated AI pipeline, and generate venue assessments including Quality scores, Risk scores, verdicts, tips, and Review Integrity Alerts.

3.2 AI-Generated Content

Venue assessments are generated algorithmically. They are not editorial opinions, professional inspections, health certifications, or guarantees of any kind. You should not rely solely on Goler assessments when making decisions that affect your health or safety.

3.3 No Paid Influence

Goler does not accept payment from venues to influence scores, verdicts, or rankings. We do not offer premium listings, paid score improvements, or advertising placements that affect venue assessments.

4. User-Generated Content

4.1 Your Content

You retain ownership of your User Content. By submitting User Content, you grant Goler a worldwide, non-exclusive, royalty-free license to use, process, analyze, display, reproduce, and distribute your content in connection with operating the Service.

4.2 Content Standards

Your User Content must not:

  • Contain false, misleading, or fabricated information about a venue or any person.
  • Be submitted in exchange for payment, discounts, or other incentives from a venue unless clearly disclosed.
  • Contain hate speech, threats, harassment, or content that promotes violence.
  • Infringe the intellectual property rights of any third party.
  • Contain malware, spam, or automated submissions.
  • Impersonate another person or misrepresent your identity.

4.3 Review Integrity

We reserve the right to flag, deprioritize, or remove User Content that violates our Content Standards.

5. Venue Owners

5.1 Venue Listings

Goler generates venue listings based on publicly available information. Venues are listed automatically and do not require opt-in.

5.2 Claiming a Venue

Venue owners may claim their listing through the venue administration panel with verification of ownership.

5.4 Disputes

If you believe a venue assessment contains a factual error, you may file a dispute. Goler will review disputes in good faith but is not obligated to alter algorithmically generated scores.

5.5 No Removal Right

Venues that operate publicly are subject to public analysis. We do not remove venue listings upon request.

6. Messaging

The Service allows users to send messages to venues. We reserve the right to review messages in response to reports of abuse. You agree not to use the messaging system to send spam, threats, harassment, or solicitations.

7. Intellectual Property

The Service, including its design, algorithms, scoring methodology, signal taxonomy, AI pipeline, branding, and all associated content is the property of Goler, Inc. and protected by applicable law. You may not copy, modify, distribute, or create derivative works without our prior written consent.

8. DMCA and Copyright

If you believe that content on the Service infringes your copyright, submit a notice to legal@goler.co including: description of the copyrighted work, location of infringing material, your contact information, a statement of good faith belief, and your signature.

9. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or extract the source code or scoring methodology.
  • Scrape or use automated means to access the Service without our prior written consent.
  • Interfere with or disrupt the Service or its infrastructure.
  • Attempt to gain unauthorized access to any part of the Service.
  • Submit fake reviews, manipulate venue scores, or engage in review fraud.
  • Resell or commercially exploit any part of the Service without our prior written consent.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. GOLER IS NOT A HEALTH INSPECTOR, FOOD SAFETY AUTHORITY, OR REGULATORY BODY. OUR ASSESSMENTS ARE STATISTICAL ANALYSES OF VISITOR FEEDBACK AND SHOULD NOT BE TREATED AS PROFESSIONAL CERTIFICATIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLER, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless Goler, Inc. from any claims, liabilities, damages, losses, and expenses arising out of your use of the Service, your User Content, or your violation of these Terms.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States.

13.2 Informal Resolution

Before initiating any formal dispute, contact us at legal@goler.co and attempt to resolve informally for at least 30 days.

13.3 Jurisdiction

Disputes shall be resolved in the state or federal courts located in Delaware.

14. Changes to These Terms

We may update these Terms from time to time. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
